Using the Manhattan website

Manhattan reserves the right, to amend, alter, or update these terms at any time, and you agree to be bound by such amendments, alterations, or updates on all subsequent visits. When you use this site, you agree to the terms and conditions on this page. If you do not agree, you are not permitted to use the site.

In the event of any pricing errors on the Manhattan website, Manhattan will not be compelled to honour incorrect prices.

Placing an order

As soon as your credit, charge or debit card has been processed, this completes your order and confirms that we have accepted it.

Your confirmation email is simply to inform you that your request has been received and will be dealt with, and does not in any way denote acceptance of your order regardless of any wording on the email. Manhattan reserves the right to refuse any order or any part of an order, or to require further information to enable it to evaluate any order at any time prior to acceptance.

Without prejudice to the statutory rights afforded to consumers under English law, Manhattan accepts no liability for failure to ship products where this is a result of an inability to do so resulting from factors outside of Manhattan’s own control, or its decision on reasonable grounds not to do so for reasons of suspicion of credit card fraud or any similar reason, provided that it takes all reasonable steps to alert you to this within fourteen days of order that the order will not be shipped.

In the event of this, Manhattan will not process payment or will immediately refund payment in full if already processed. It is your responsibility to make sure that you place your order with Manhattan with sufficient time to prevent any loss or disappointment resulting from such non-shipment.

Delivery dates are estimated - Manhattan accepts no liability in the event of any third party cost due to late deliveries for any reason. If an order is expected to be delivered more than 21 days after the order date, Manhattan will give you the option of cancelling or changing your order.

Delivery

Manhattan delivers to mainland England and Wales – if you live outside of this area, please contact us for a quotation for delivery.

It is your responsibility to inspect goods on delivery for any damage, including damage caused in transit (other than manufacturing faults) before you sign the driver's delivery note. Once you have signed for the products (even if you write "unchecked" or similar) you accept that goods arrived without obvious external damage to packaging. Subsequent claims for carrier damage will not be considered.

Missing items must be reported to Manhattan within 48 hours of delivery – we cannot accept liability for missing items that are not reported to us within this timeframe.

If the driver refuses to wait while you check goods you must refuse to accept the delivery. If goods are undamaged and you refuse delivery you will be responsible for the cost of returning and redelivering goods. Do not arrange for a tradesman to install items bought on the Manhattan website until after they have been delivered and checked for damage. Your delivery will take place between 9am and 6pm, Monday to Friday. We will contact you to organise when your delivery appointment will be. All deliveries will be made by a single driver – you are responsible for providing access and help, where necessary, in assisting the driver in carrying any heavy items.

Any goods small enough to be delivered by post will be – in this instance, you are responsible for opening boxes and examining items for damage. In the event of any type of damage, you agree to sign the paperwork with the word “damaged”, or reject the delivery. Please notify us of any damage within 48 hours of delivery. If someone else is signing for goods on your behalf, you agree to advise them to check goods for damage. You are responsible for any loss or damage in the event of someone else signing on your behalf and failing to carry out the necessary checks. You agree to indemnify Manhattan in full for any losses we suffer as a result of you accepting goods and signing a delivery note without checking for damage.

Returns policy – changing your mind

Under the Consumer Protection (Distance Selling) Regulations 2000 / Returns, since 31 October 2000 UK consumers have had the right to cancel an order within a 'cooling off period' lasting 7 days from the day after taking delivery. This must be done by fax, email or letter. Our address can be found in the “Contact Us” section of this website. In the event of this, you agree to return items to Manhattan in good condition. Or, you will be responsible for our costs in recovering the goods. It is your responsibility to make sure goods are undamaged and unused.

Returns policy - faulty goods

All faulty or damaged goods must be reported within seven days of delivery. Claims for faulty or damaged goods must be made in writing, via email to orders@manhattanshowers.co.uk within this period. Please include a description of the damage and photographic evidence where possible.

We do not accept returns for damaged goods once they have been fitted.

Manhattan products all come with a 12-month manufacturer’s guarantee. Longer guarantee periods quoted on this website are provided by the manufacturer and are not in any way supported by Manhattan.

After sales care is provided by many of the manufacturers we deal with – if you experience a problem following installation, an engineer may be available to examine and/or fix problems. Where applicable, Manhattan will provide you with the telephone number of the manufacturer's after sales team so you can arrange their site visit directly.

If the item is faulty or missing parts, you should inform the manufacturer immediately. Replacement items and spare parts shall be sent to you via the individual manufacturer’s preferred postage method and will be replaced free of charge.

Cancelling orders

In the event of cancellations due to items failing to be dispatched, no charge will be incurred. For items that have been successfully dispatched, Manhattan reserves the right to charge you for any costs relating to the return of goods, as well as a 25% restocking charge on orders more than seven days’ old.

Manhattan will not be held responsible for incorrect measurements on the part of the customer or fitter – the customer agrees to make sure items ordered are the right size for the space available. Manhattan will not accept returns for items ordered incorrectly.

External Sites

Manhattan is not responsible for the availability or the content located on or through any external website linked in any way to the Manhattan website. Manhattan cannot be held responsible for any transactions between you and such sites (including as to 'cookies', personal data, confidential information, or purchases of goods or services).

Privacy Policy

Please take the time to read our Privacy Policy very carefully - it tells you how we will treat your personal information. By using any Company sites ("Site") and services, you unconditionally and irrevocably agree to be bound by this Privacy Policy. We want to offer you the best possible user experience, so from time to time we will introduce additional functions, features, products and services into the Company web sites. Because of this and our commitment to protecting your privacy there may be occasional changes to this Privacy Policy, so please remember to refer back to the policy regularly to review any amendments.

Why do we collect and use personal information?

In order to:

  • Process your orders or applications
  • Verify your identity
  • Anticipate and resolve problems with any goods or services supplied to you
  • Customise the service we provide to you
  • Carry out our obligations in relation to any agreement you have with us
  • Carry out market research and track sales data

If we need to collect and process personal information about you, this will consist of your name, a user name, gender and date of birth. We will also ask you to provide the answer to a security question, such as your mother's maiden name – this will be used to confirm your identity if you forget your password. We may ask you for this information through our Site, or a member of our customer service team may request it.

It is not compulsory that you provide us with every piece of information we request. However, providing us with plenty of accurate information enables us to improve our services to you. Some services may be offered in conjunction with other companies and they may need to see personal information from you too. In this instance, we will inform you prior to you using that service. Certain services may be unavailable if you do not disclose the personal information you are asked to provide.

Disclosing your information to others

Other than the disclosures referred to in this policy, we will not disclose any personal information without your permission unless:

(i)  we are legally entitled or obliged to do so (for example, if required to by court order or for the purposes of prevention of fraud or other crime)
(ii)  in the event that we undergo re-organisation or are sold to a third party, in which case you agree that personal information we hold about you may be transferred to that restructured entity or third party.

Log files/IP addresses

Your IP address is the unique address that identifies your computer on the Internet – this is automatically recognised by our web server and logged by us, in the event of criminal activity being suspected or reported to us.

Non-personal information

Non-personal information about you such as the type of Internet browsers you use or which links directed you to our Sites may be automatically collected by Manhattan. You cannot be identified from this information.

Information placed on your computer

We may store some information on your computer when you look at our Sites. This information enables us to use our Sites and helps us to provide you with high service levels.

Commonly known as "cookies", this information allows you to access our site without re-entering your personal details every time you visit. It also helps us to show you web content and adverts relevant to you.

You can delete or block cookies if you wish – refer to your screen or manual to find out how to do this. However, certain services may not work properly if your browsers are set to reject cookies.

Security

We endeavour to safeguard your privacy at all times and use the latest technology to protect you from unauthorised access and improper use. We continuously update our security policies as new technology becomes available to guarantee we provide you with a safe and secure environment to browse and shop.

Third party sites

Manhattan cannot be held responsible for the privacy policies and practices of other web sites - even if you access them using links from our Sites. We advise our customers to check the policy of each site they visit.

If you linked to any of our Sites from a third party web site, we cannot be responsible for the privacy policies and practices of the owners or operators of that third party site. Again – we strongly advise you to check the policy of that third party site and contact its owner or operator if you have any concerns or questions.

Transferring personal information outside the European Economic Area Information provided to us as part of the services offered to you through our Site may be transferred to countries outside of the European Economic Area ("EEA").

This may happen, for example, if our servers or service providers is situated outside of the EEA. These countries may not the same data protection laws to the EEA. If we transfer your information outside of the EEA in this way, we will take steps to ensure that your privacy is protected. If you use our services while you are outside the EEA, your information may be transferred outside the EEA in order to provide you with these services.
